INVISIONGAMING TERMS OF SERVICE/ ACCEPTABLE USE POLICY
General Rules:
- No user shall "snoop" (Look,spy in) any directory except for their home directory
- No user shall run emech bots (Without consent of from InvisionGaming)
- No user shall run a bot net or have a bot net on their IRCD (Grounds for account termination)
- No user shall use a private (EX: Kyle.Admin.InvisionGaming.net) vhost that does not belong to them
- Any user found snooping around directory's other then their own will have a 2 day account suspension.
- All users will pay their bills on time or have their accounts terminated without notice
- InvisionGaming has a 4 day money back guarantee.(Warranted Reasons Only)
- If you dispute a charge that in InvisionGaming's view was perfectly legal then you agree to pay InvisionGaming an administrative fee of no less then $15 and no more then $200
- Users with webhosting accounts are not to run eggdrops, bncs, or any processes unless they buy the corresponding service. (PHP Bots Included)
Main Body:
- WebHosting/Shell Customers: Any user caught running ShoutCast servers or GameServers will have a 5 day account suspension and an email warning unless they purchase the corresponding service.
- VPS Customers: All VPS customers must promptly answer and respond to any and all abuse reports from InvisionGaming. Failure to do so could result an account suspension. VPS customers are NOT to run IRC servers unless their IP's are in the 208.98.* range. Users may request transfers at any time. VPS customers are treated to a "fair use policy", if a user's VPS is adversely effecting the other VPS's on the machine and or the whole machine itself then the user will be warned and or transferred to another server to meet their processing needs.
- Disclosure to Law Enforcement: The AUP specifically prohibits the use of our service for illegal activities. therefore, Subscriber agrees that InvisionGaming may disclose any and all subscriber information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification to the Subscriber. In addition InvisionGaming shall have the right to terminate all service set forth in this Agreement.
Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company. Subscriber further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.
- Spam: InvisionGaming takes a zero tolerance approach to the sending of Unsolicited Commercial Email (UCE) or SPAM over our network. Very simply this means that customers of InvisionGaming may not use or permit others to use our network to transact in UCE. Customers of InvisionGaming may not host, or permit hosting of, sites or information that is advertised by UCE from other networks. Violations of this policy carry severe penalties, including termination of service.
Violation of InvisionGamings SPAM policy will result in severe penalties. Upon notification of an alleged violation of our SPAM policy, InvisionGaming will initiate an immediate investigation (within 48 hours of notification). During the investigation, InvisionGaming may restrict customer access to the network to prevent further violations. If a customer is found to be in violation of our SPAM policy, InvisionGaming may, at its sole discretion, restrict, suspend or terminate customers account. Further, InvisionGaming reserves the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation. InvisionGaming will notify law enforcement officials if the violation is believed to be a criminal offense.
- As our Customers are ultimately responsible for the actions of their clients over the InvisionGaming network, it is advisable that Customers develop a similar, or stricter, policy for their clients.
- System and Network Security: Users are prohibited from violating or attempting to violate the security of the InvisionGaming Network. Violations of system or network security may result in civil or criminal liability. InvisionGaming will investigate occurrences, which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations. These violations include, without limitation:
- » Accessing data not intended for such User or logging into a server or account, which such User is not authorized to access.
- » Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization.
- » Attempting to interfere with service to any user, host or network, including, without limitation, via means of overloading, "flooding", "mail bombing" or "crashing".
- » Forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting.
- » Taking any action in order to obtain services to which such User is not entitled.
- InvisionGaming wishes to emphasize that in agreeing to the InvisionGaming Acceptable Use Policy (AUP) and Terms of Service (ToS), customer indemnifies InvisionGaming for any violation of the Acceptable Use Policy (AUP) and Terms of Service (ToS) that results in loss to InvisionGaming or the bringing of any claim against InvisionGaming by any third-party. This means that if InvisionGaming is sued because of a customers or a customer of a customers activity, the customer will pay any damages awarded against InvisionGaming, plus all costs and attorneys fees.
- InvisionGaming takes no responsibility for any material input by others and not posted to the InvisionGaming Network by InvisionGaming. InvisionGaming is not responsible for the content of any other website's linked to the InvisionGaming Network; links are provided as Internet navigation tools only. InvisionGaming disclaims any responsibility for any such inappropriate use and any liability to any person or party for any other person or party's violation of this policy.
InvisionGaming is not responsible for any damages your business may suffer. InvisionGaming does not make implied or written warranties for any of our services. InvisionGaming denies any warranty or merchantability for a specific purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by InvisionGaming.
You, as InvisionGamings customer, are solely responsible for the content stored on and served by your InvisionGaming server.
- ShoutCast Customers: InvisionGaming has the right at any time to suspend a ShoutCast account if the user goes over his allotted bitrate (Default 96 kbps).
- Abuse Towards Our Staff or Network Staff: Abuse Towards our staff or our network staff will not be tolerated, If you use foul language, threaten us, or anything we may find offensive, we may suspend your account, or if we decide, delete it and offer no refund. Per Our AUP and TOS, We offer No Refunds if you abuse our staff.
- Cancellation Policy: A user may cancel their service via a support ticket and/or the PayPal website (Depending on the used payment method).
InvisionGaming has the right at anytime to modify this document and change it at will.
